Boral Construction Court Outcome
The recent penalty imposed on Boral Construction Materials Group Ltd for unlawfully interfering with Aboriginal heritage is deeply disappointing. Despite pleading guilty to two charges under the Aboriginal Heritage Act 1975, Boral was fined only $25,000 plus court costs—a figure that represents less than 10% of the maximum penalty allowed. This lenient fine fails to reflect the gravity of damaging cultural heritage sites of immense significance to Aboriginal people, nor does it provide the strong deterrence needed to prevent such breaches by large corporations in the future.
This outcome highlights the need for stronger legislative measures that ensure more effective deterrence and meaningful protection of Aboriginal cultural sites. The Aboriginal Heritage Council look forward to new Aboriginal heritage legislation that will introduce clearer, tougher penalties and enhanced enforcement mechanisms to safeguard these irreplaceable cultural assets for future generations.
